Terms of Service — Carsmenskii

The short version: Carsmenskii sells advice, research, and digital products. I'm paid only by you, never by a dealer. Refunds on digital products are unconditional within 7 days. I retain copyright on everything I write; you're free to use my products for personal car-buying. Disputes are governed by Ontario law. Plain-language details below.

1. Agreement to these terms

By using carsmenskii.com, booking a call, subscribing to my newsletter, or purchasing any of my products or services, you agree to these Terms of Service. If you don't agree, please don't use the service.

2. What I provide

Carsmenskii is an independent car-buying advisory service operated by David Kamenskii in Toronto, Ontario. I offer:

Matchmaking engagements at three tiers (The Match, The Search, Concierge) for clients looking for help finding the right car.
Digital products including the Pre-Purchase Inspection Checklist, The Negotiation Playbook, Manual Cars in Canada, and the Deep Dive series of model-specific buyer's bibles.
Free content via the journal, buyer's guides, the cost-of-ownership calculator, and The Carsmenskii Brief newsletter.

Each engagement and each product is described on its own page on carsmenskii.com. The description on that page, plus these Terms, plus the Privacy Policy, is the full agreement between you and Carsmenskii unless I sign a separate written engagement letter.

3. Your responsibilities as a client

For the service to work, I need you to:

Provide accurate, complete information when I ask for it (questionnaire, budget, timeline, prior cars, etc.)
Tell me if anything material changes during the engagement (budget shifts, timeline changes, new info about the car you're targeting)
Respect that the recommendations I make are advice, not orders. The final purchase decision is always yours.
Not redistribute my digital products to anyone outside your household, or post them publicly.

4. Payment

All prices on carsmenskii.com are in Canadian dollars (CAD).

Digital products are paid through Stripe at the time of purchase, and the file is delivered by email shortly after. Prices include applicable Canadian sales tax (GST/HST) where required.
Matchmaking engagements are invoiced before work begins. Payment is by credit card, e-transfer, or another method I agree on. The Concierge tier may be invoiced in stages on larger engagements.
Custom engagements outside my standard tiers are quoted in writing in advance.

5. Refund policy

Digital products

Unconditional 7-day refund. Email david@carsmenskii.com with "refund" in the subject and the order number. I don't ask why; I don't argue. If 7 days have passed since purchase, refunds are at my discretion.

Matchmaking engagements

Before work begins: full refund.
After the questionnaire is delivered, before the first call: 50% refund.
After delivery of a shortlist or sourcing report: no refund, but if the deliverable doesn't fit, I'll do a second round at no additional cost (one extra round on The Match, up to three rounds on The Search and Concierge).

What I don't guarantee

I can't guarantee a specific car at a specific price. The market changes, sellers change their minds, and individual cars sell. I guarantee the work — the research, the shortlist, the sourcing process, the negotiation — and I guarantee that I'll keep working until you have a defensible answer.

6. Intellectual property

All content on carsmenskii.com — text, photos, graphics, PDFs, the questionnaire, the framework — is owned by Carsmenskii and protected under Canadian and international copyright. By purchasing a digital product, you receive a perpetual, non-exclusive, non-transferable license to mee it for your personal car-buying purposes (including handing the PPI Checklist to your mechanic and the Negotiation Playbook to your spouse). You may not:

Resell, redistribute, or sub-license my content
Post my content publicly (in whole or in substantial part)
Use my content to train machine-learning models without explicit written permission
Remove copyright or attribution notices

You retain ownership of any information you share with me about yourself or the car you're buying. I retain ownership of the analysis, recommendations, and reports I produce. My internal templates and frameworks remain mine.

7. Disclaimers

Carsmenskii provides information, research, and advisory services. I am not:

A licensed mechanic, body-shop technician, or appraiser
A licensed dealer or broker
A lawyer, accountant, or financial advisor
An insurance agent

My recommendations reflect my best independent judgment based on publicly available information, my experience, and what you've told me. They are not warranties or guarantees about a specific vehicle's mechanical condition, accident history, future reliability, future resale value, or fitness for any particular purpose.

I strongly recommend an independent pre-purchase inspection by a qualified mechanic on any vehicle before you buy it. The 142-Point PPI Checklist exists to help you do exactly that.

The website and my digital products are provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by Canadian law.

8. Limitation of liability

To the maximum extent permitted by applicable law, Carsmenskii (and David Kamenskii personally) shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of my services or products — including but not limited to lost profits, loss of data, business interruption, or vehicle-related costs that arise after purchase.

Where liability cannot be excluded, my total aggregate liability to you is limited to the amount you paid me for the specific service or product giving rise to the claim, in the 12 months prior to the event.

Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be limited under applicable Canadian law.

9. Term and termination

These Terms apply from the moment you first use the service and continue until terminated. Either party may terminate an active matchmaking engagement at any time by written notice; refund treatment follows section 5.

I may suspend or terminate access to my services if you breach these Terms, harass me or other clients, attempt to misuse my content, or use the service in a way that creates legal risk for me. I'll always explain why and give you a chance to remedy it where reasonable.

10. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.

If I have a disagreement, I agree to first try to resolve it directly and in good faith. If that doesn't work, the courts of the Province of Ontario shall have exclusive jurisdiction. You and Carsmenskii both waive the right to a jury trial where applicable.

If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms remains in effect.

11. Changes to these terms

I may update these Terms from time to time as the service or the law evolves. The "last updated" date at the top of the page reflects the most recent revision. For material changes, I'll notify newsletter subscribers and post a notice on the homepage. Continued use of the service after changes are posted constitutes acceptance of the new Terms.
