Carsmenskii is an independent car-buying advisory service operated by David Kamenskii in Toronto, Ontario. I offer:
Each engagement and each product is described on its own page on carsmenskii.com. The description on that page, plus these Terms, plus the Privacy Policy, is the full agreement between you and Carsmenskii unless I sign a separate written engagement letter.
For the service to work, I need you to:
All prices on carsmenskii.com are in Canadian dollars (CAD).
Unconditional 7-day refund. Email david@carsmenskii.com with "refund" in the subject and the order number. I don't ask why; I don't argue. If 7 days have passed since purchase, refunds are at my discretion.
I can't guarantee a specific car at a specific price. The market changes, sellers change their minds, and individual cars sell. I guarantee the work — the research, the shortlist, the sourcing process, the negotiation — and I guarantee that I'll keep working until you have a defensible answer.
All content on carsmenskii.com — text, photos, graphics, PDFs, the questionnaire, the framework — is owned by Carsmenskii and protected under Canadian and international copyright. By purchasing a digital product, you receive a perpetual, non-exclusive, non-transferable license to mee it for your personal car-buying purposes (including handing the PPI Checklist to your mechanic and the Negotiation Playbook to your spouse). You may not:
You retain ownership of any information you share with me about yourself or the car you're buying. I retain ownership of the analysis, recommendations, and reports I produce. My internal templates and frameworks remain mine.
Carsmenskii provides information, research, and advisory services. I am not:
My recommendations reflect my best independent judgment based on publicly available information, my experience, and what you've told me. They are not warranties or guarantees about a specific vehicle's mechanical condition, accident history, future reliability, future resale value, or fitness for any particular purpose.
I strongly recommend an independent pre-purchase inspection by a qualified mechanic on any vehicle before you buy it. The 142-Point PPI Checklist exists to help you do exactly that.
The website and my digital products are provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by Canadian law.
To the maximum extent permitted by applicable law, Carsmenskii (and David Kamenskii personally) shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of my services or products — including but not limited to lost profits, loss of data, business interruption, or vehicle-related costs that arise after purchase.
Where liability cannot be excluded, my total aggregate liability to you is limited to the amount you paid me for the specific service or product giving rise to the claim, in the 12 months prior to the event.
Nothing in these Terms limits liability for fraud, gross negligence, or any other liability that cannot be limited under applicable Canadian law.
These Terms apply from the moment you first use the service and continue until terminated. Either party may terminate an active matchmaking engagement at any time by written notice; refund treatment follows section 5.
I may suspend or terminate access to my services if you breach these Terms, harass me or other clients, attempt to misuse my content, or use the service in a way that creates legal risk for me. I'll always explain why and give you a chance to remedy it where reasonable.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.
If I have a disagreement, I agree to first try to resolve it directly and in good faith. If that doesn't work, the courts of the Province of Ontario shall have exclusive jurisdiction. You and Carsmenskii both waive the right to a jury trial where applicable.
If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms remains in effect.
I may update these Terms from time to time as the service or the law evolves. The "last updated" date at the top of the page reflects the most recent revision. For material changes, I'll notify newsletter subscribers and post a notice on the homepage. Continued use of the service after changes are posted constitutes acceptance of the new Terms.
